1. Overview

These Terms of Service (“Terms”) are a binding agreement between you and Friend Cult (“the Cult", "we", "our", or "us"). These Terms and Conditions govern your use of our website located at friendcult.co (the "Website") and applications (“Apps”), which includes third-party apps we use for socializing, scheduling, and events. The Terms also govern use of our services (“Services”), which include: (i) benefits and services offered on the Website and Apps, (ii) access to our premises and events, and (iii) interactions with our social space e.g. text, email, social media and spoken conversation with applicants, guests, members, affiliates, and employees of Friend Cult (“Cultists”). 

By accessing or using our Website, Apps, and Services - including as a guest in our physical social spaces - you agree to comply with and be bound by these Terms and Conditions. Please read these Terms and Conditions carefully before use. If you do not agree to these terms, you should not use the Cult’s Website, Apps, or Services.

The Cult reserves the right to modify or update these Terms and Conditions at any time. Changes will be effective upon posting to the Website. Your continued use of the Website following the posting of changes constitutes your acceptance of the updated Terms and Conditions.

2. Membership and Eligibility

  • Eligibility: Membership in the Cult is open to all individuals who are at least 18 years old. If you apply, you represent that you meet this eligibility requirement.

  • Applications: By applying to be a member you acknowledge that interviews are a prerequisite to membership and not all applicants will be accepted as members. 

  • Application Information: If you apply, you agree to provide accurate, current, and complete information as required by the registration process. 

  • Termination of Membership: The Cult reserves the right to suspend or terminate your membership and access to the Website, Apps, and Services at any time if you violate these Terms and Conditions or engage in conduct that we determine to be harmful to the Cult or other members. 

3. User Conduct

By engaging with our Website, Apps, or Services you agree to conduct yourself appropriately and lawfully. Without limiting the generality of the foregoing, you agree to abide by the following code of conduct:  

  • (a) Do not harass or threaten other Cultists - either digitally or in person. 

  • (b) Do not transmit any User Content that is illegal, offensive, abusive, racist or otherwise harmful on our apps or to our Cultists

  • (c) Do not falsely represent yourself as any other person or transmit false or misleading information

  • (b) Do not transmit material that contains viruses or engage in ‘hacking’-type behaviors

  • (c) Do not disrupt or interfere with the security of Friend Cult, its website, third party apps, resources, accounts, etc. 

  • (h) Do not make any representation, express or implied, that any statements you make are endorsed by the Cult, without our prior written consent

Failure to adhere to this code of conduct may result in the immediate suspension or termination of your membership. 

4. Electronic Communications

By using any of our Website, Apps, and Membership Services, you consent to receiving electronic communications from the Cult, which may include text messages, emails, instant messages, and communication through Apps. These communications may include: event invitations, announcements, updates, alerts or notifications about membership or billing, newsletters or other Cult-related information. These electronic communications are part of your relationship with us and constitute a core part of our Services. The following rules apply to our communications, and you can find more information in our privacy and data policy: 

  • Consent: By becoming a member, you agree to receive electronic communications from the Cult. If you do not wish to receive certain types of communications, you may opt-out either by following the instructions provided in those messages (e.g. by clicking an ‘unsubscribe’ link in an email) or by contacting us directly via text or email. 

  • Communication Etiquette: Members are expected to use email and text messages for appropriate purposes. Any communication that is abusive, harassing, or inappropriate will be considered a violation of these Terms and Conditions. The Cult reserves the right to take appropriate action, including suspension or termination of membership, for misuse of electronic communication channels.

  • Opting Out: You may choose to stop receiving electronic communications at any time by following the unsubscribe instructions included in our emails or by contacting us. Please note that even if you opt-out of certain communications, the Cult may still send you important notices related to your membership, such as updates on policies or critical information regarding Cult activities.

  • Responsibility for Communications: The Cult is not responsible for any miscommunication, delay, or failure in delivering electronic messages due to incorrect contact information provided by you, issues with your email service provider, or any other technical issues beyond our control.

5. Intellectual Property

User Content: You may have the ability to submit, post, or upload content (including but not limited to text, images, and comments) to the Website or our Apps ("User Content"). By submitting User Content, you grant the Cult a worldwide, royalty-free, non-exclusive, perpetual license to use, modify, display, and distribute your content for the purpose of promoting the Cult and its activities.

Friend Cult Content: All content and materials provided on our Website, Apps and Services (other than User Content) are the intellectual property of the Cult or its licensors. The website and apps are protected by intellectual property rights. You may not copy, distribute, or modify any content from the Website without our prior written consent. You may not create derivative works based on the Website in whole or in part, or exploit for commercial purposes any portion of the Website, without the Company’s prior written authorization. 

6. Account and Information Security

By using our Website and Apps - including using email or text messages to digitally represent yourself to us -  you accept responsibility for their security e.g. with passwords. In the event of unauthorized use or access to your accounts or theft of your identity, you agree to agree to notify us immediately. We cannot and will not be liable for any loss or damage arising from failure to comply with this section.
